CYBER CRIME AND COURT ROOM CHALLENGES
On 21/3/2021 Saveetha School of Law conducted a webinar on "Cyber Crime And Court Room Challenges” The session is handled by Mr. Shiva Surya Narayan, practicing advocate of Madras HC. The speaker began the session with a brief introduction about cyber crime and the laws pertaining to it. He then moved on with the procedural challenges in collecting evidence because of the transnationation nature of these crimes. More often than once these cases are marred by the jurisdictional challenges and the difficulties in handling highly volatile electronic evidence. Investigative officers themselves are not trained in e- discovery and preservation of electronic evidence. This poses challenges in preserving the chain of custody of electronic evidence subsequently for trial. He explained in detail the procedures to be followed while producing electronic evidence in court, including S. 65(B) certificate. He reiterated the need for periodic training to both the investigating officers as well as the judges in handling the electronic evidence, for better trial and conviction of cyber crimes in India.
