Maintenance under 125CrPc and Hindu Adoption and Maintenance Act

The discussion started with various measures adopted to protect social justice and laws framed to safeguard the interest of women and children , old and poor parents. Law commission report and recommendations were also discussed. The need to construe the provisions liberally to give social justice to women and children enabling them to avail natural and fundamental rights were discussed with the aid of case laws.  How to make an application of section 488 of Cr. P. C , need of explaining the complaint to husband, what are the points to be proved before a maintenance order, proof of marriage and in case of denial of marriage, the questions to be inquired by the magistrate, grounds on which order may be refused, finding out the actual means of the husband ,need for considering the social position of wife etc were discussed . The lecture also concentrated on the manner in which courts interpreted the provisions to provide a speedy remedy by a summary procedure to enforce liability.
