A Lecture on Application of Forensic Science with reference to Medical Negligence.

The webinar was about Medical negligence and it’s current aspects and emerging threat. The general implications of medical Negligence was explained along with the elements required in proving negligence and concentrated the key elements with the necessary components for a legal claim. The concept of duty of care, breach of duty, causation and damages all were discussed with illustrative cases. He elucidated the significance of section 304A of IPC which deals with the cause of death by negligence and also the importance of section 174 of Code of Criminal procedure and its practical applicability. He further acknowledged the topic of contributive theory of negligence where both the parties are responsible for the negligence and also covered civil and criminal aspects. The difference of civil negligence involving compensation and criminal negligence involving fine with imprisonment was also discussed in detail.
