National Webinar on Legal Reasoning

A National Webinar on Legal Reasoning was conducted by Saveetha School of Law on 19th September, 2020 . The guest lecturer was Dr. Sandeep Menon Nandakumar, who is currently an Associate Professor at MS Ramiah College of Law. He has also authored a book on ‘Corporate Human Rights Accountability in India’. The workshop was co-ordinated by Mohammed Haroon of 2nd Year, BA.LLB. The faculty co-ordinator was Mr. Rajkhanna, Associate Professor, Saveetha School of Law.

The webinar gave the students an insight about the various dimensions of legal reasoning and emphasized on the need to integrate morality with legal reasoning. The guest speaker explained how jurists in the past have realized mistakes committed by them decades later after a judgement is given. The guest speaker referred to many examples which helped the students understand the complex and changing nature of legal reasoning

Resource person gave an in depth details about Arbitration and it's proceedings.It gave a clear cut practical applicability in dispute resolution through arbitration. The differentiations can be found during practicing rather than studying (For example, sole arbitrator is not practically acceptable but theoretically it's being studied as sole arbitrator). Also mentioned some internationally recognized arbitrations for our knowledge. Saveetha school of law students Shantilal.S,Akshita.B.N and S.Sandhesh Saravanan emerged as the winner in the competition,”1st Virtual National Moot Court Competition “conducted by an up and coming legal website named Legalzems

It's a wholly student-run organization.

The competition comprised of 30 teams from all over the nation. The problem was centred on the sensational Citizenship Amendment Act developments And the Assam Accord.

It was a strenuous journey over a period of 3 days, hardly fought competition.

All the knockout rounds comprised of Highly esteemed judges who were active Practitioners and judges in the SC.

After a lot of riveting ups and downs in our journey to the final, our team held it's nerve in the final as the Judge darted difficult questions at us. Eventually we emerged triumphant and our hardwork paid off rightfully so.

Victim Compensation for crimes against women in India

The webinar was conducted by Ms. Swarnalatha who is practising as an advocate in Madras High court. She started her discussion with detailed analog of what victim compensation is and how it is scattered and implemented in India. She highlighted about the various schemes that have been implemented in many states. Also about the need for uniformed scheme across India. Also how there can be misuse of the law and people can take advantage of it where the innocents can be exploited. She gave insight-upon United Nations General Assembly Declaration of Basic Principles of Justice for Victim and Abuse of Power adopted in November 1985, which through Article 1&2. The legislative framework in Indian regarding compensation to victim of crime can be trace through two major legislations i.e. Code of Criminal Procedure, 1973 and Probations of Offenders Act and Constitution of India, explained how the payment of compensation of victim had evolved. The Hon'ble Courts have taken a view ( with regard to monetary aspect) when question of the award of compensation come under Cr.P.C. as compare to when it comes under Constitution.

He then acknowledged the participants about the process and procedure of arbitration proceeding in detail and highlighted various segments of it, such as what matters can be arbitrated upon, the need of arbitration clause, who can be the parties to the arbitral proceedings, appointment of arbitrators, number of arbitrators, and the time span to conclude an arbitral proceedings. He also explained how the arbitration moves from pleadings, to framing of issues, to producing evidence, to arguments, to passing of an arbitral award and finally enforcement of an arbitral award. The webinar on a whole was very informative and helpful for the participants to understand the subject of arbitration in India.
